Terms of Service

These Terms of Service ("Terms") govern your access to and use of FieldOps365, a software-as-a-service platform operated by SwatiLabs LLP ("SwatiLabs", "we", "our", or "us"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Definitions

  • Service means the FieldOps365 platform, including all features, APIs, and mobile interfaces.
  • Customer or you means the organisation or individual that subscribes to the Service.
  • Users means employees, contractors, vendors, and agents who access the Service on behalf of the Customer.
  • Data means all content, work orders, documents, and other information you submit to the Service.

2. Account Registration

To use the Service, you must register and create a workspace. You agree to provide accurate, current, and complete information during registration and to update such information as needed. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

3. Subscription and Payment

FieldOps365 is offered on a subscription basis. Subscription fees are charged in advance on a monthly or annual basis, in Indian Rupees (INR) plus applicable GST. Free trial periods are available to new accounts. SwatiLabs reserves the right to modify pricing with 30 days' written notice. If you opt for manual payment (bank transfer or UPI), your account will be activated upon confirmation of receipt by SwatiLabs.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation, including those related to data privacy, labour, or GST compliance.
  • Upload or transmit content that is unlawful, defamatory, obscene, or infringing on third-party rights.
  • Attempt to gain unauthorised access to any part of the Service or its underlying infrastructure.
  • Interfere with or disrupt the integrity or performance of the Service or data of other users.

5. Data Ownership and Security

You retain ownership of all Data you submit to the Service. SwatiLabs will not sell your Data to third parties. We implement commercially reasonable technical and organisational measures to protect your Data. However, no method of electronic storage or transmission is 100% secure, and we cannot guarantee absolute security.

6. Intellectual Property

The Service, including its software, design, trademarks, and documentation, is owned by SwatiLabs LLP and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service solely for your internal business operations during the term of your subscription.

7. Service Availability

SwatiLabs aims to maintain high availability of the Service but does not guarantee uninterrupted access. Scheduled maintenance, upgrades, and unforeseen outages may temporarily affect access. SwatiLabs will endeavour to provide advance notice of planned downtime wherever possible.

8. Termination

Either party may terminate the subscription at any time. Upon termination, your access to the Service will cease. SwatiLabs will retain your Data for 90 days following termination, after which it may be permanently deleted. You may request a data export within this window by contacting support.

9. Limitation of Liability

To the maximum extent permitted by law, SwatiLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. SwatiLabs' total aggregate liability shall not exceed the fees paid by you in the three months preceding the event giving rise to the claim.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

11. Changes to Terms

SwatiLabs may update these Terms from time to time. We will notify you of significant changes via email or through the Service. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.
